Charge

A Professional Conduct Committee laid two charges of professional misconduct against Ms Nicola Tolland, midwife of Whangaparoa (the Midwife).

The first charge alleged the Midwife misled the Midwifery Council and that she failed to engage with the Council in regard to competence, registration and practising certificate issues.  The second charge alleged she practised without a practising certificate during the following periods:

  • 18 July - 16 September 2008;
  • 30 November - 3 December 2008;
  • 16 January - 1 April 2009.

Finding

The Midwife represented herself at the hearing and provided the Tribunal with a one page response to the charge which essentially set out her agreement to the charge.  The Tribunal found that cumulatively the particulars of the first charge amounted to professional misconduct and that the second charge was also established.

Penalty

The Tribunal censured the Midwife, fined her $500 and ordered her to pay costs of $4,000.  The Tribunal also imposed a condition that for a period of three years the Midwife must practise under professional supervision with a supervisior approved by the Midwifery Council.  It was ordered that the supervision should focus on the Midwife's recertification progres and on her professional responsibilities.
