Charge

A Professional Conduct Committee laid two charges of professional misconduct against Ms Kassee Flavell-Neville, midwife of Warkworth (the Midwife).

The first charge alleged the Midwife failed to engage in or complete a Recertification Programme despite being requested to do so by the Midwifery Council and that she failed to apply for an APC from 1 April 2012 to 31 March 2013.  The second charge alleged she continued to practise as a midwife without a practising certificate for the period 1 April 2012 to 27 July 2012.

Finding

The hearing proceeded by way of an Agreed Summray of Facts and the Midwife accepted that the charges amounted to professional misconduct.  The Tribunal found both charges established.

Penalty

The Tribunal ordered that, from the resumption of practice, the Midwife practise under the followinging conditions:

  • for two years she is to practice with other registered midwives or in an employed capacity.  She is required to have a mentor in that practice or employment, whose identity will be advised to the Midwifery Council;
  • for 18 months, she is to practice under a supervisor appointed by the Midwifery Council;|
  • for one year, she will have a maximum caseload of four cases per month;
  • within one year of resuming practice, she shall undertake a Midwifery Standards Review;  and
  • within three months of resuming practice, she shall undertake an adult CPR and neonatal resuscitation course, according to Midwifery Council requirements.

In addition to the above conditions, the Tribunal censured the Midwife and directed publication of its decision and a summary.
