Charge

At a hearing held on 27 August 2019 the Health Practitioner’s Disciplinary Tribunal considered a charge laid by the Professional Conduct Committee appointed by the Medical Council of New Zealand against Mr Linto Thomas, (the nurse) formerly of Wellington. 

The charge laid, alleged that the nurse’s conduct reflected adversely on his fitness to practise.  The charge showed that the nurse had been convicted in the Palmerston North District Court on two counts of indecent assault on a patient. 

Background

The hearing proceeded on the basis of formal proof from the PCC as the nurse did not attend or engage in the hearing process and was believed to be overseas.   

Finding

The Tribunal was satisfied that the charge was made out and reflected adversely on the nurse’s fitness to practise. 

Penalty

The Tribunal censured the nurse and cancelled his registration.  The Tribunal ordered that the nurse pay a contribution of 40% of the total costs of the PCC and the Tribunal.
