Charge
On 1 - 2 May 2014 the Health Practitioners Disciplinary Tribunal considered two charges laid by the Professional Conduct Committee against Mr Marc Adams (the Dental Technician), registered Dental Technician and Clinical Dental Technician of Auckland.

The first charge alleged that the Dental Technician provided services directly to the public when he knew they were outside of his scope of practice and were restricted activities under the Act that he was not permitted to perform as a Dental Technician.  The second charge alleged that the Dental Technician practised without a current practising certificate from April 2009 to September 2012.

Finding

The hearing proceeded on the basis of an agreed summary of facts with the Dental Technician largely accepting the charges brought against him, with the exception of some particulars in relation to the first charge.

The Tribunal was satisfied that both of the charges were established and the conduct required disciplinary sanction.

Penalty

The Tribunal censured the Dental Technician and imposed conditions on his practice.  The Dental Technician was also ordered to pay a fine of $4,500 and costs of $22,000 as a contribution to the costs of the Tribunal and the PCC.
