Precis of Decision: Charge
At a hearing held 20 February 2018, the Health Practitioners Disciplinary Tribunal considered a charge laid by the Professional Conduct Committee (PCC) against Mr Jose Miguel Dy (the Nurse) of Auckland.
The charge alleged that the Nurse behaved in an inappropriate or unprofessional manner by harassing, bullying members of staff and misrepresenting his authority to hire and fire staff.
The Nurse did not attend the hearing, it therefore proceeded on a formal proof basis. The Nurse provided a written submission prior to the hearing and again before the Tribunal considered penalty.
Findings
The Tribunal had no hesitation in finding the charges were made out and that disciplinary sanction was necessary.
Penalty
The Tribunal censured the Nurse and cancelled his registration. The Tribunal ordered the Nurse to pay a total contribution of $9,000 towards the costs of the Tribunal and the PCC.
