Charge

 

On Monday 8 October 2018 the Health Practitioners Disciplinary Tribunal considered a charge laid by a Professional Conduct Committee against Ms Jane Moore, registered physiotherapist of Gisborne (the Physiotherapist).

 

The charge alleged that:

 

1. Between 2012 and 2016 she conducted herself in an inappropriate and/or unprofessional manner in relation to her clinical record keeping by:

 

  • Failing on approximately 200 occasions to keep a complete contemporaneous record of patient treatment and progress.
  • Removing from her workplace approximately 137 patient files which contained personal and health information.
  • Misplacing approximately 118 patient files which contained personal and health information.

 

2. Between 15 February 2017 and 9 March 2018 she acted in an unprofessional manner by failing to respond to communications about her conduct from the Physiotherapy Board.

 

3. Between 1 April 2017 and 18 April 2017 she practised without a current Annual Practising Certificate (APC).

 

Finding

 

The hearing proceeded on the basis of an agreed summary of facts and the Physiotherapist admitted that she was guilty of professional misconduct and that she practised without an APC.

 

The Tribunal was satisfied that each of the particulars of the charge were established.

 

Penalty

 

The Tribunal censured the Physiotherapist and ordered that conditions be placed on her practice for two years.  The conditions were imposed to ensure that the Physiotherapist remain diligent in her maintenance of patient files.  She was further ordered to pay costs and the Tribunal directed that the decision and summary of the decision be published.
