Charge

 

At a hearing held in Christchurch on 12 - 13 February 2019 the Health Practitioner's Disciplinary Tribunal considered 4 charges of professional misconduct laid by the Professional Conduct Committee against Johan Peter Van Der Meer (the Nurse) of Christchurch.

 

Charges 1, 2 and 3 alleged that the Nurse failed to maintain professional boundaries with a patient under his care and that he sold and listed items on Trade Me, belonging to the patient without explicit permission.  Charges 2, 3 also alleged that the Nurse failed to account for the money received from the sale of those goods.  Charge 4 alleged that the practitioner accepted gifts from a health consumer who was or had been under his care.

 

Findings

 

The hearing proceeded by way of an agreed summary of facts.  The Tribunal found that the charges were made out and amounted to professional misconduct by the Nurse and warranted disciplinary sanction.

 

Penalty

 

The Tribunal censured the Nurse, suspended his registration as a nurse for 3 months and imposed conditions on resumption of practice.  The Nurse was ordered to pay $13,500 as a contribution towards the costs of the Tribunal and the PCC.
